After 20 years of working for her employer in a job that required her to perform repetitive movements, the client developed problems with her shoulder which were attributable to her job duties. Unfortunately, her claim was denied by the workers compensation carrier. During the claim, the failure of the workers compensation carrier to provide timely benefits to the client caused her to develop neck problems as well. After retaining the firm, we pursued benefits for the client’s claim under an occupational disease theory and litigated the case to a successful result before the Industrial Commission. The case was ultimately settled for a substantial sum while on appeal.
Client injured her back while working at a nursing home. Even though the workers compensation carrier accepted the claim as compensable, the employer and carrier forced the client to return to work at a job outside of her restrictions, terminated her benefits and fired her from employment. After retaining this firm, we were able to convince the employer and carrier that the work was not suitable and client received a significant settlement for benefits as well as Social Security disability benefits.
After falling at work, client had surgery for an injury to his ankle. After the surgery, client developed complications and was diagnosed with RSD or complex regional pain syndrome. Despite sporadically providing weekly benefits to the client for lost time from work, the workers compensation carrier refused to provide appropriate medical treatment. The firm was able to obtain authorization for the proper medical treatment for the client condition and the matter was ultimately resolved by a settlement taking into consideration the clients future medical needs and lost time from work.
